The court of Tirana decided on May 21, 2018 to give the right to an employee who had sued the Call Center Company where she worked for dismissal without right, by deciding to award compensation.
Employee F.D., represented in court by lawyer Gridi Shehu, resigned last year in violation of the Labour Code. She initially turned to the Together for Life, which came to her aid through consulting and further assisting her in taking the case to court.
The employee has requested the ascertainment of the invalidity of the termination of the Employment Contract, as well as the obligation of the employer to provide compensation. The violations were related to the non-observance of the notice deadlines for the immediate termination of the contract, the non-recognition of the paid leave time, etc.
After about a year of dismissal, the court decided to entitle the employee and decide on her compensation.
During the trial, the legal representatives of the Call Center Companyclaimed that the employee violated the Internal Regulation and the Employment Contract. These claims of the company were not proven during the lawsuit, therefore, the court partially accepted the Claim, imposing the obligation of the Call Center company, for compensation of 9 (nine) months of work salaries, for non-compliance with the procedure and legal criteria in the Labour Code, during the termination of the employment contract.
Together for Life is implementing the Project "Social Mobilization for Labor Rights", financially supported by the Olof Palme International Center. This project envisages activities aimed at promoting labor rights movements in the Call Center sector and raising awareness of these rights, establishing dialogue between employees, employers and state authorities, as well as advocating for decision-makers and public executive institutions for improving work standards in Call Center companies.
